Driving while suspended is one of the most common and serious charges in municipal court. N.J.S.A. 39:3-40 provides that, “no person to whom a driver’s license has been refused or whose driver’s license or reciprocity privilege has been suspended or revoked or who has been suspended or revoked or who has been prohibited from obtaining a driver’s license shall personally operate a motor vehicle during the period of refusal suspension, revocation, or prohibition.” A person whom is convicted of driving while suspended or on the revoked listing may also receive some stiff penalties.
A driver is most often placed on the revoked listed in two possible ways. One method is a court order by a Municipal Court Judge. The other way a driver is placed on the revoked list is the result of administrative action issued by the New Jersey Division of Motor Vehicles.
There are many reasons why a driver may be suspended: A driver’s failure to comply with a court installment payment order; failure to appear at a court date; failure to pay parking tickets; failure to pay surcharges; failure to pay child support.
There are two types of license suspensions; the first is a court imposed suspension and the second is an administrative suspension, from the Division of Motor Vehicles.
